By accessing or using our platform, users and Vendors agree to the following Terms & Conditions (“Terms”), which govern all interactions on Cedar Grove International Ltd.’s digital marketplace. Please read these Terms carefully before listing services or making bookings.
1 Introduction
Cedar Grove International Ltd. Ltd operates an online marketplace that enables Vendors to list tourism-related services, including but not limited to:
- Vehicle rentals (cars, motorbikes, tuk-tuks)
- Boat charters and marine tours
- Short-let accommodations
- Guided experiences and adventure packages
Customers use the platform to browse and book services directly from Vendors. Cedar Grove International Ltd. facilitates these connections but does not own, manage, or guarantee any listed service.
2 User Eligibility
To use the Cedar Grove International Ltd. plarform:
- Users must be at least 18 years old.
- Vendors must provide truthful, up-to-date business information and adhere to Kenyan legal requirements applicable to their services.
3 Vendor Obligations
All Vendors are expected to:
- Post accurate listings, including descriptions, pricing, and availability.
- Comply with all Kenyan laws and sector-specific regulations such as:
- Road Traffic Act for vehicle rentals
- Merchant Shipping Act for marine services
- Tourism Act (2011) for guided tours and experiences
- Public Health Act and county-level bylaws for accommodations and venues
- Independently manage bookings, customer engagement, and service delivery.
- Resolve disputes in good faith and maintain a professional standard of service.
4 Commission-Based Payment Model
Cedar Grove International Ltd. charges no upfront subscription fees. Instead, it applies a commission fee on each confirmed booking processed through the platform.
Details:
- The commission rate is defined during onboarding and may vary by service category.
- Cedar Grove International Ltd. deducts its commission before remitting payouts to Vendors.
- Rates may be updated occasionally, with reasonable notice provided via email or platform alerts.
5 Bookings and Payments
Customers make bookings directly with Vendors via Cedar Grove International Ltd.’s secure platform. Vendors are responsible for:
- Accepting payments through legally recognized channels in Kenya (e.g., M-Pesa, bank transfer, credit cards).
- Issuing receipts and managing cancellations or refunds as appropriate.
- Adhering to standard consumer protection and financial service regulations.
6 Termination and Suspension
Vendors may delist services at any time, provided no active bookings are pending. Cedar Grove International Ltd. reserves the right to:
- Suspend or remove listings that violate platform policies, mislead users, or breach legal standards.
- Terminate access for users engaging in fraudulent, harmful, or illegal activity.
Note: Commission fees already deducted are non-refundable.
7 Limitation of Liability
Cedar Grove International Ltd. acts solely as a listing and booking intermediary. It:
- Does not offer or manage listed services.
- Is not liable for damages, disputes, cancellations, accidents, or service failures.
- Assumes no financial or legal responsibility for transactions or user behavior.
Vendors accept full operational responsibility and agree to indemnify Coastofika against any claims.
8 Amendments
Cedar Grove International Ltd. may update these Terms at any time. Material changes will be communicated via platform alerts or email. Continued use of the platform signifies acceptance of the revised Terms.
9 Governing Law
These Terms shall be governed by the laws of the Republic of Kenya, including:
- National statutes applicable to digital commerce, tourism, and transportation
- County-level business operation and safety regulations
- The Kenya Data Protection Act (2019) for handling user information
